Welcome to LightLog. Please read these LightLog Terms of Use (the “Terms”) carefully before using the Service. By downloading, installing, accessing, or using LightLog, you acknowledge that you have read and agree to be bound by these Terms. If you do not agree to any part of these Terms, please stop using LightLog.
These Terms incorporate and supplement Apple’s standard Licensed Application End User License Agreement (EULA). If there is any conflict between these Terms and the Apple EULA, the stricter requirement permitted by applicable law shall prevail.
For the avoidance of doubt: the display name of the App Store developer account is used for platform distribution and display purposes only and does not by itself change the contracting-entity designation under these Terms; rights and obligations related to LightLog are borne by the publisher (contracting entity) identified above.
1. Definitions
- “LightLog” or the “Service” means the film photography logging application and related functions provided by Kago Studio, including but not limited to film roll management, shooting parameter logging, gear management, photo matching, export, and local data organization.
- “User” means any individual or entity that downloads, installs, registers for, accesses, or uses LightLog.
- “Content” means any information entered, imported, managed, exported, or displayed by a user through LightLog, including but not limited to text records, shooting parameters, gear information, photos, metadata, and exported files.
- “Subscription Services” means recurring paid features or benefits that LightLog may provide now or in the future (such as advanced features, bulk-processing capabilities, or other value-added services).
2. Service Description
2.1 LightLog is positioned as a film photography workflow logging and management tool, helping users organize rolls, record shooting information, manage gear, and match photos.
2.2 LightLog is not intended to replace professional development/scanning, archiving, or rights-management systems; users should back up and verify data according to their own needs.
2.3 Unless otherwise stated, LightLog primarily runs using local device capabilities. Certain features may rely on Apple system capabilities (such as photo permissions, iCloud, and subscription billing).
2.4 We may update, adjust, limit, or discontinue parts of the Service based on product evolution, compliance requirements, or operational needs.
3. User Eligibility and Accounts
3.1 You must have civil capacity suitable for your conduct.
3.2 If you are a minor, please use LightLog under the guidance and with the consent of your legal guardian.
3.3 If certain LightLog features require an Apple account or system permissions, you must ensure such account use and authorizations are lawful, valid, and revocable.
4. User Responsibilities and Acceptable Use
4.1 Users are solely responsible for their use of LightLog and all resulting consequences.
4.2 Users must ensure they have lawful sources, rights, or authorizations for any Content they input, import, export, or share.
4.3 Users must not use LightLog for unlawful or non-compliant activities, including but not limited to:
- infringing others’ copyrights, trademarks, portrait rights, privacy rights, or other lawful rights;
- uploading, storing, or disseminating illegal, harmful, abusive, defamatory, obscene, or otherwise improper content;
- interfering with or disrupting normal operation of the Service, or bypassing reasonable functional restrictions via technical means.
4.4 If a user’s conduct leads to third-party claims or regulatory inquiries, the user shall bear corresponding legal liability and indemnify Kago Studio and its proprietor against losses.
5. Intellectual Property
5.1 Intellectual property rights in the LightLog application itself (including but not limited to UI design, code, copy, graphics, trademarks, and related technology) belong to Kago Studio, its proprietor, or relevant rights holders.
5.2 Certain UI elements, icons, fonts, system assets, or third-party components used in the app may be owned by their respective rights holders in accordance with law; rights in such materials remain with the original rights holders and are not transferred by inclusion in LightLog.
5.3 For third-party materials used under open-source licenses, font licenses, or asset license agreements, we will comply with applicable license obligations (including, where required, retaining copyright notices, license texts, or attribution).
5.4 Users retain rights to their own content to the extent permitted by law.
5.5 Without prior written consent of the relevant rights holder, no person may copy, modify, reverse engineer, rent, sell, or commercially exploit LightLog software, content, or related materials, except as expressly permitted by law.
6. Privacy and Data
6.1 We value user privacy. Specific data-processing rules are set out in the LightLog Privacy Policy.
6.2 LightLog is designed to minimize unnecessary data collection; features involving system permissions (such as Photos or Location) are enabled only after authorization is granted.
6.3 Users should back up important data themselves. Users acknowledge and assess risks of data loss caused by device failures, system errors, user mistakes, third-party service interruptions, or force majeure.
7. Subscriptions, Fees, and Auto-Renewal
7.1 Some LightLog features may now or in the future be offered on a paid basis; specific pricing, entitlements, and terms are shown in-app.
7.2 Subscriptions purchased via Apple channels are billed to and managed through the Apple ID account.
7.3 Subscriptions generally auto-renew unless auto-renew is canceled at least 24 hours before the end of the current billing period.
7.4 Renewal charges (if applicable) will be made by Apple within 24 hours before the end of the current subscription period.
7.5 After purchase, you may manage or turn off auto-renewal in your Apple ID account settings.
7.6 Any pricing-display or settlement differences arising from payment-channel rules, exchange rates, tax policies, or regional requirements are subject to Apple’s actual rules and billing.
8. Third-Party Services and System Dependencies
8.1 Certain LightLog capabilities depend on system frameworks and services provided by Apple or other third parties.
8.2 We provide no additional warranties regarding availability, stability, or compliance of third-party services; their own terms and privacy policies apply separately.
8.3 If features are limited due to third-party failures, restrictions, policy changes, or termination, we will provide reasonable assistance and explanations, but assume no liability beyond that required by law.
9. Disclaimers and Limitation of Liability
9.1 As-Is Basis: LightLog is provided on an “as is” and “as available” basis, without express or implied warranties that the Service will be uninterrupted, error-free, or fully meet any particular purpose.
9.2 User Decision Responsibility: Users should use logging, matching, and export features based on their own judgment and bear corresponding risks.
9.3 Exclusion of Indirect Damages: To the maximum extent permitted by applicable law, Kago Studio and its proprietor are not liable for any indirect, incidental, special, punitive, or consequential damages.
9.4 Aggregate Liability Cap: Where complete exclusion is not permitted by law, Kago Studio and its proprietor’s aggregate liability arising from your use of LightLog is limited to the amount you actually paid (if any) for relevant services in the 12 months preceding the dispute.
10. Service Changes, Suspension, and Termination
10.1 We may temporarily interrupt or adjust parts of the Service for maintenance, upgrades, compliance, operations, or security reasons.
10.2 In case of significant legal risk, infringement disputes, abuse, or security incidents, we may restrict, suspend, or terminate relevant features or services as necessary.
10.3 For foreseeable major service changes, we will endeavor to notify users via in-app notices or other reasonable means.
11. Updates to the Terms
11.1 We may update these Terms based on business changes, legal/regulatory requirements, or compliance needs.
11.2 Updated Terms will be published via the app, official website, or other reasonable channels, with an updated effective date.
11.3 Continued use of LightLog after updates constitutes acceptance of the updated Terms; if you do not agree, you should stop using the relevant services.
12. Governing Law and Dispute Resolution
12.1 These Terms are governed by and construed in accordance with the laws of the People’s Republic of China (excluding conflict-of-laws rules).
12.2 Any dispute arising out of or relating to these Terms shall first be resolved through friendly negotiation; failing that, either party may bring a lawsuit before a court with jurisdiction in the locality of Kago Studio’s proprietor.
13. Miscellaneous
13.1 Headings are for convenience only and do not affect interpretation of these Terms.
13.2 If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.
13.3 Any failure or delay to exercise rights under these Terms does not constitute a waiver of such rights.
13.4 The Simplified Chinese version is the primary reference text; in case of inconsistencies with other language versions, the Simplified Chinese version shall prevail unless mandatory law provides otherwise.
